Acc+Ess Limited's customers are covered by the terms of The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Our terms of trade will aim to offer customer protection that fully complies with these Regulations and where possible extend beyond them.
These Terms of Sale covers the situations where the customer is purchasing goods or services from Acc+Ess Limited via mail order or at exhibitions or wherever else the customer makes a purchase directly with Acc+Ess Limited.
We will provide a full description of the goods or service being offered by Acc+Ess Limited on our website(s) and all sales and descriptive literature. The description will include the total price of the good or service including Value Added Tax and the rate of tax will also be shown. If the purchase covers a long term commitment, this will describe the length of the commitment and the specific terms of the commitment.
Where delivery charges are levied in addition to the purchase price of a good or service where the customer is responsible for paying these charges, they will be detailed in full, and where geographic regional variations exist, these will be shown in detail.
Cancellations and Refunds
Ordered but not yet delivered
The customer can cancel an order at any time prior to delivery without incurring any penalties and a full refund will be made by the same method that was used to pay for the goods or service.
Goods or service delivered in good condition
The customer can return any goods or cancel any service which has been delivered to the customer no more than FOURTEEN calendar days before the date that Acc+Ess Limited receives notification from the customer by email, post or telephone to cancel the goods or service. In this case, the customer can request Acc+Ess Limited to provide a reply paid label for the return of the goods free of charge to the customer. Once the goods have been returned to Acc+Ess Limited and found to be of good condition, Acc+Ess Limited will provide a full refund to the customer using the same method that was used to pay for the goods. A service provided by Acc+Ess Limited can be cancelled within the above period of fourteen days whereupon Acc+Ess Limited will provide a full refund to the customer using the same method that was used to pay for the service.
Where the customer cancels goods received within fourteen days before the date of cancellation are part of a multiple consignment, the goods are deemed to be received on the date when the last batch of the multiple consignment has been received.
If the customer wishes to cancel goods or services which have been delivered to the customer more than fourteen days prior to the date that Acc+Ess Limited has received the customer's notification to cancel the goods or service, Acc+Ess Limited will accept the goods in good condition, but the customer will be responsible for paying for the delivery of the goods to Acc+Ess Limited.
For services to be cancelled which have been provided to the customer more than fourteen days prior to the date that Acc+Ess Limited has received the customer's notification to cancel the goods or service, Acc+Ess Limited will provide a full refund to the customer using the same method that was used to pay for the service minus an administration charge of £25 net of VAT or prorata any proportion of a long term subscription that has already been used, whichever is the greater. For example, if Acc+Ess were to offer a subscription service for, say, £48 per annum and the customer chooses to cancel the subscription three months after the service was provided to the customer, Acc+Ess would refund the £48 paid less 3/12ths or £12. However, because this amount is less than £25, Acc+Ess will refund the customer £48 minus £25, or £23.
How to cancel goods or services
Acc+Ess Limited provides a cancellation form on its website, protocab.com, which the customer can use either directly online or by printing the form and sending it to Acc+Ess Limited at the addresss shown at the foot of every webpage on the Acc+Ess Limited website. The customer should not arrange to return the goods being cancelled before receiving an acknowledgement of cancellation by email or post from Acc+Ess Limited.
Acceptance of Returned Goods by Acc+Ess Limited
Acc+Ess Limited reserves the right to refuse a refund or to make a charge where goods being returned as a result of cancellation are not in good condition, not returned in the original packaging unopened and/or with any alteration or addition to the packaging or where the goods have been received by Acc+Ess Limited more than fourteen days after the date of acknowledgement of cancellation provided by Acc+Ess Limited.
The customer should get a refund within 14 days of either Acc+Ess Limited receiving the goods, or the customer providing evidence of having returned the goods (for example, a proof of postage receipt from the post office), whichever is the sooner.
Acc+Ess Limited warrants that its products will be free from defects and suitable for the intended purpose for a period of one calendar year from the date of purchase. Some products and services may be covered by extended warranties which may or may not be chargeable.
Terms of Sale or Use of Digital Content
Separate terms apply to any digital content provided for sale or free of charge by Acc+Ess Limited and these terms are shown on the respective product page on the Acc+Ess Limited website.
Confirmation of Sale
All orders received and accepted by Acc+Ess Limited will be confirmed by email or post according to the customer's wish. If confirmed by email, the confirmation will be in a form that enables the customer to print it to paper or saved to electronic media if the customer so decides.
